Actually now that you mention it I think you are half right after looking into it more.
It does seem like it is actually heavily regulated and not necessary illegal, but I guess this would mean illegal for unlicensed people to sell.
If I had to guess most sellers in the us with tritium in their products aren’t selling tritium but rather selling procured items with tritium and thats probably a legal workaround for that.

I don’t think Microsoft really did anything extra, I think the media just got trended real hard.
I had known about Microsoft’s work on this topological chip for at least a year before the recent rage about it thanks to a youtube channel called domain of science who went over what was happening here, he is a quantum hardware developer first but stopped to make this YouTube channel which creates maps of various fields of science, its a very good channel highly reccomend it!
